Terms of Use
The Perfect Bite
Effective: TODO date
Contact: [email protected]
The Perfect Bite is a grocery list, recipe and meal plan app you share with your household. These terms are the rules for using it. By using the app, you agree to them. “We” means John Gerard Paschal.
Your account
- You sign in with Apple or Google. (There’s also an email and password sign-in, used only for Apple’s app review.)
- You must be 13 or older to use the app. If you’re under 18, you need a parent or guardian’s permission to use the app, and they agree to these terms for you.
- The app is offered only in the United States.
- Keep your device and the account you sign in with secure. You’re responsible for what happens in the app through your account. If you think someone else has used it, contact us.
Households and sharing
Everything in the app belongs to a household: its lists, items, recipes and meal plan. Every member of a household can see and edit all of it, and sees your name and profile picture. Members can also invite others, and a household’s owners can remove members or delete the household with everything in it.
So invite only people you trust, and don’t put anything in a shared household you wouldn’t want its members to see.
Your content
- In the app, what you add belongs to the household: your lists, recipes, notes and photos. Every member can see, change or delete it, and it stays with the household if you leave or delete your account. You keep any copyright you have in it, such as in your own photos, and you allow the household to keep using it after you leave. If you’ve left and need something removed, email us.
- Using the app doesn’t give you rights in someone else’s content, such as a recipe you import from a website or a photo someone else took; that stays its owner’s.
- You give us permission to store, copy, sync, process and show your content only as needed to run the app for you and your household, as described in the Privacy Policy. That includes sending it to our service providers, sending it to AI providers when you (or, for shared recipes, another member of your household) use an AI feature, and keeping the limited logs the policy describes. The one exception: ingredient names you add also join a shared catalog used by everyone on the app, without your name attached, so the app can sort them into aisles. We don’t use your content for anything else.
- When you delete something, leave a household or delete your account, what happens to your content is described in the Privacy Policy. Things you added to a shared household stay there for its other members.
- Don’t add content you have no right to use, such as photos you didn’t take or text you’re not allowed to copy. When you import a recipe from someone else’s website or cookbook, it’s for your household’s own use.
- If you think something in the app infringes your copyright, email us and we’ll look into it.
AI features
AI features are optional. The app asks you once whether to use them, and you can change your answer any time in Settings > AI features. The Privacy Policy explains what each one sends and to whom. Your answer covers what your own app sends: another member of your household who allows AI can use it on the household’s shared recipes, including ones you added.
If you allow them, AI sorts items into aisles, imports recipes from a link or from photos, suggests tags, matches ingredients to steps and can make a photo for a recipe. AI makes mistakes. It can get ingredients, amounts, steps and allergens wrong, or miss them. Always check a recipe yourself before you cook it, and take extra care with allergies and dietary needs. Don’t rely on the app for medical or safety decisions.
Fair-use limits apply. Recipe imports and AI photos have a monthly allowance per household, shared by its members, and each person has daily and per-minute limits on AI features. The app tells you when you reach one. Use the app as a person would: no scripts, bots, scraping or bulk use, and no trying to get around the limits.
Food safety and allergies
The Perfect Bite isn’t a source of food safety, allergy, nutrition or medical advice. Recipes in the app can come from AI, from websites, from photos or from other members of your household, and any of them can be wrong or incomplete, including about ingredients, amounts, allergens and cooking times or temperatures. Always check the original recipe and the food labels yourself. If you or someone you’re cooking for has an allergy or dietary need, you’re responsible for making sure the food is safe for them.
Paid features
The app is free to use. We may offer paid features in the future. We’ll tell you before anything changes, and you’ll never be charged unless you choose to buy.
Acceptable use
Don’t:
- use the app to break the law or to harass, harm or deceive anyone;
- try to get into other people’s accounts or households, or into our servers;
- reverse engineer, copy or resell the app, or interfere with how it works;
- upload anything harmful, such as malware.
Availability
We work to keep the app running, but we can’t promise it will always be available or free of errors. We may add, change or remove features.
The app keeps a copy of your household’s data on your phone so it works offline, and syncs when you’re back online. When two people change the same thing at once, the latest change usually wins, and a delete wins over an edit. Anything you change offline reaches your household only once it syncs, and could be lost if you delete the app or sign out before it does.
Ending your use
You can stop using the app and delete your account at any time, in Settings > Delete account.
We may suspend or close an account that breaks these terms or puts other people or the service at risk. Where we reasonably can, we’ll tell you first.
Disclaimers and limitation of liability
To the extent the law allows:
- The app is provided “as is” and “as available”, without warranties of any kind.
- We’re not responsible for mistakes in recipes, amounts, aisles or AI results, or for what you cook or buy based on them.
- We’re not liable for indirect or consequential losses, or for lost data. Our total liability to you for anything related to the app is limited to the greater of what you’ve paid us in the past 12 months or $50.
Some places don’t allow these limits, so they may not all apply to you. Nothing here takes away rights you have by law.
Apple’s terms
You get the app from Apple’s App Store, and your license to use it is Apple’s standard Licensed Application End User License Agreement. These terms are separate: they cover how you use the service behind the app (your account, households, content and AI features) and don’t replace Apple’s agreement. These terms are between you and us, not Apple. Apple isn’t responsible for the app or its content, or for support, maintenance or any claims about it, including claims that the app infringes someone’s intellectual property. If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund what you paid for it, if anything; Apple has no other warranty obligation. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries. You confirm you aren’t in a country under a US government embargo or on a US government list of prohibited or restricted parties.
General
These terms are governed by the laws of the State of Texas. Any dispute goes to the courts there.
If part of these terms can’t be enforced, the rest still applies. We may transfer these terms and the app to someone else, for example if we form a company or sell the app, and we’ll tell you if we do.
Changes to these terms
We may update these terms. We’ll change the date at the top, and tell you about significant changes in the app or by email before they take effect. If you keep using the app after that, the new terms apply.
